AMERICANS FOR CITIZEN VOTING: NEW YORK COURT OF APPEALS: ONLY CITIZENS VOTE

NEW YORK, March 21, 2025 ~ In a recent ruling, the New York Court of Appeals struck down a law that would have allowed non-citizens to vote in municipal elections. The law, which was passed by the city council in 2022, has been on hold as it made its way through the court system.

The decision was met with praise from Americans for Citizen Voting, a group that has been advocating for citizen-only voting across the country. "We are thrilled with the decision from the Court of Appeals," said Avi McCullah, president of Americans for Citizen Voting. "Voting in the United States should be reserved for citizens of the United States."

The organization works with citizens in various states to amend state constitutions and clarify that non-citizens are not allowed to vote in state and local elections. While they are pleased with this ruling in New York, they also acknowledge that there have been conflicting decisions in other states.

McCullah pointed out that three other states with similar language in their state constitutions have allowed non-citizens to vote in local elections. This includes cities in California and Maryland where a loophole allows foreign citizens to vote.

According to McCullah, this issue should not be left up to judges' interpretations but rather decided by the people at the ballot box. He argues that it is important for each state to make their own decision on whether or not non-citizens should have the right to vote.

Since 2018, 14 states have passed Citizen Only Voting Amendments including Alabama, Colorado, Florida, Idaho, Iowa, Kentucky, Louisiana, Missouri, North Carolina, Ohio, Oklahoma, North Dakota, South Carolina and Wisconsin. Efforts are currently underway in Arkansas, Indiana, Kansas Mississippi Montana Nebraska Texas and West Virginia.

South Dakota has already referred a Citizen Only Voting Amendment to their 2026 ballot and several other states have pending legislation to do the same.
