GREELEY, Colo. - Nyenta -- The case involves a petition filed by the Colorado Avalanche and Ace American Insurance Company, challenging a decision by the Colorado Division of Workers' Compensation (CDOWC) to reopen the player's workers' compensation claim—nearly a decade after it was initially closed. The motion to set aside the claim closure centers on critical procedural issues, including whether official documents were sent to the correct address in 2016.

The Colorado Avalanche and its insurer argue that the claim was properly closed when the former player did not respond to a show-cause order. However, the CDOWC recently vacated that closure after Michael Kaplan argued that the documents were mailed to an incorrect address, thereby depriving the player of "proper" notice, which resulted in a violation of the player's Due Process rights.  The reopening of the claim now grants the player access to all applicable benefits under the Colorado Workers' Compensation Act, as if the claim had never been closed.

"This case raises important questions about due process, notice, and the rights of injured workers—even those with international ties," said Michael Kaplan, attorney and one of the founding partners at Kaplan Morrell. The case, Colo Avalanche LLC et al. v. Tauriello, Paul et al., has been filed in the 2nd Judicial District of Colorado (Case No. 2025CV33587). The Avalanche and its insurer are seeking to halt the reopened claim until an evidentiary hearing is held.
