~ In a recent development, the City has reiterated its stance that the Police Accountability Board (PAB) does not have the authority to publish internal investigative reports. According to the City's legal position, this action would violate local law, the automatic stay of the Fourth Department's decision in the NYCLU matter, and the City's own Code of Ethics.
The PAB's charter clearly outlines its ability to release data on complaints received and their resolutions, as well as quarterly and annual reports containing this information. However, the information released on Sunday does not fall under these categories.

The City has expressed concern over the potential consequences of publicly releasing allegations of misconduct that may be inaccurate or have already been proven false. This could have a detrimental impact on an employee's personal and professional life, regardless of whether or not they are correctly identified in the report.
On Friday, Sept. 20, the City provided a detailed four-page letter to PAB staff and board members outlining their legal perspective on this matter. The City remains firm in its belief that publication of internal investigative reports by the PAB is not within their jurisdiction.
